HOW TO ENTER

Beginning Monday, February 8 at 9:00 a.m. Mountain Time (MT) and ending on Monday, April 5, 2010 at 5:00 p.m. MT (the "Contest Period") current Shaw customers are eligible to enter the Win With Movie Central Contest (the "Contest").  There are two ways to enter the Contest:

Online: Go to www.encoreavenue.ca and complete the online entry form;

OR

Mail in: Mail in your entry with your full name, mailing address, telephone number, age, and name of television service provider to: Movie Central: "Win With Movie Central" Contest, 64 Jefferson Ave. Unit 18, Toronto, ON, M6K 3H4. Attn: V. Minhinnick

Entry is limited to One (1) entry per day (including mail entries) per e-mail address during the Contest Period.

Only one e-mail address and account may be used by any person to enter the Contest.  If it is discovered in the ordinary course of running the Contest that an entrant has attempted to enter the Contest more than Once (1) per day during the Contest Period or use more than one e-mail address all of that entrant's entries shall be disqualified.   Movie Central reserves the right to disqualify all such entrants from future contests conducted by Movie Central without further notice. 

The Sponsor of this Contest is Movie Central Ltd., ("Movie Central").

CONTEST CLOSING DATE

Eligible entries must be received by Movie Central no later than Monday, April 5, 2010 at 4:59:59 p.m. MT (the "Contest Closing Date"). Mail in entries must also be received by the Contest Closing Date and must be post-marked before the Contest Closing Date.

GRAND PRIZE

There is One (1) Grand Prize available to be won. The Grand Prize consists of:

• One (1) trip for two (2) adults to Los Angeles, California including:
  • Return economy flights for two (2);
  • Two (2) nights standard hotel accommodations (based on double occupancy);
  • One (1) VIP tour of the Sony Studios including transportation to and from studio from hotel.  No other travel arrangements will be made by Movie Central.
  • One (1) One (1) year Movie Central subscription; and
  • Five Hundred US Dollars ($500),

Approximate retail value of the Grand Prize is Four Thousand Canadian Dollars ($4,000 CDN). 

SECONDARY PRIZE

There are Two (2) Secondary Prizes available to be won. Each Secondary Prize consists of:

• One (1) Shaw HD PVR (EXCLUDING INSTALLATION AND ACTIVATION FEES); and

Approximate retail value of the Secondary Prize is Three Hundred and Ninety Eight Canadian Dollars ($398 CDN). 

NOTE:  Installation and activation fees for the PVR are not included in the Secondary Prize. Please contact your local Shaw representative for details as costs may vary according to region.  The High Definition PVR is compatible with Standard Definition televisions and cable reception.

GRAND PRIZE DECLARED WINNER AND HIS/HER GUEST MUST BE AVAILABLE TO TRAVEL APRIL 5, 2010 to AUGUST 31, 2010.

A valid major credit card must be provided by either the declared Grand Prize winner or his or her guest for hotel check-in and incidentals. 

The Grand Prize as described is subject to availability, may not be exchanged for cash, is non-refundable, non-salable, must be accepted "as awarded" and must be used on the dates specified by Movie Central.  Absolutely no changes are permitted to travel arrangements once the declared winner has submitted the name of his/her Grand Prize traveling companion and all related booking information to Movie Central.  At its sole discretion, Movie Central reserves the right to substitute any portion of the Grand Prize with a prize of equivalent or greater retail value.

NOTE:  Declared winner and his/her traveling companion shall be responsible for all travel and medical insurance, ground transportation, transfers to and from the airport and the declared winner's residence (see below), gratuities, meals, beverages (including alcoholic beverages), in-flight meals and entertainment, applicable taxes (including Airport Improvement Taxes), transfers, incidentals and any and all other expenses not specified in the description of the Grand Prize.  The departure flight shall be from an International Airport closest to the declared winner?s home.  Declared winner and traveling companion must travel together on the same itinerary and depart from the same location. Declared winner and traveling companion are responsible for ensuring that all travel papers (passports, visas, etc.) are in good order and are valid prior to and for the entire duration of the Grand Prize trip.

Certain travel restrictions apply. Please note that the Grand Prize Package does not include gratuities, departure taxes, Movie Central recommends that the declared winner and his/her travelling companion purchase medical, accident and baggage insurance.  Failing to provide the required documents may result in denied boarding by the air carrier and/or entry by immigration authorities in the United States. Movie Central is not responsible in this respect.  It is the responsibility of the declared winner and his/her travelling companion to check with the airline for baggage restrictions.

In order to be declared the winner of the Grand Prize or Secondary Prize Package, the  selected entrant must fully complete and return the Declaration and Release Form and correctly answer the accompanying mathematical skill-testing question without assistance or mechanical or electronic aid.   By fully completing the Declaration and Release Form the eligible entrant confirms his/her compliance with the Official Contest Rules, acceptance of the Grand Prize or Secondary Prize as awarded and releasing Movie Central from all liability.

The selected entrant for both the Grand Prize and Secondary Prize will be notified by telephone or e-mail at the phone number or e-mail address indicated on their Contest entries within Five (5) business days of the draw. In the event that a selected entrant is not eligible or cannot be contacted within Five (5) days of selection, such entrant will be disqualified and the judges have the right to randomly draw another prize selected entrant from the remaining eligible entries and Movie Central shall be released and discharged from any liability or responsibility in this regard. 

Prizing will only be delivered to the confirmed winner.  If the selected entrant fails to sign and return the Declaration and Release within Ten (10) business days of being notified that they have been selected as a potential winner, or within such later period of time, if any, as may be permitted by Movie Central in its sole and absolute discretion, then that entrant will be disqualified and his/her entry will be declared null and void.

GRAND PRIZE DRAW

Movie Central judges will make a random draw for the Grand Prize on Thursday, April 9, 2010 at approximately 2:00 pm MT from all eligible entries received by the Contest Closing Date. The selected entrant will be contacted by telephone from the Movie Central offices in Toronto, Ontario.  In the event that an entrant is not eligible, declines the prize or cannot be contacted within Five (5) days of the first attempt, Movie Central has the right to randomly draw another eligible entrant as a selected entrant and shall be released and discharged from any liability or responsibility in this regard.

In order to be declared the winner of the Grand Prize Package the selected entrant will be required to correctly answer a mathematical skill testing question and sign and submit an official Declaration and Release Form confirming acceptance of the Grand Prize Package as awarded and Movie Central must receive the fully completed Companion Release Form.  If a selected entrant fails to sign and return the Declaration and Release and Companion Release Form within Ten (10) days of the selection of his/her entry, or within such later period of time, if any, as may be permitted by Movie Central, in its sole and absolute discretion, then that entrant will be disqualified, his/her entry will be declared null and void and Movie Central reserves the right to select at random another eligible entry, in which event, the foregoing provisions of this sentence shall also apply to such other eligible entry.

SECONDARY PRIZE DRAW

Movie Central judges will make a random draw for the Secondary Prize on Thursday, April 9, 2010 at approximately 3:00 pm MT from all eligible entries received by the Contest Closing Date. The selected entrant will be contacted by telephone from the Movie Central offices in Toronto, Ontario.  In the event that an entrant is not eligible, declines the prize or cannot be contacted within Five (5) days of the first attempt, Movie Central has the right to randomly draw another eligible entrant as a selected entrant and shall be released and discharged from any liability or responsibility in this regard.

In order to be declared the winner of the Secondary Prize Package the selected entrant will be required to correctly answer a mathematical skill testing question and sign and submit an official Declaration and Release Form confirming acceptance of the Secondary Prize Package as awarded and Movie Central must receive the fully completed Companion Release Form.  If a selected entrant fails to sign and return the Declaration and Release Form within Ten (10) days of the selection of his/her entry, or within such later period of time, if any, as may be permitted by Movie Central, in its sole and absolute discretion, then that entrant will be disqualified, his/her entry will be declared null and void and Movie Central reserves the right to select at random another eligible entry, in which event, the foregoing provisions of this sentence shall also apply to such other eligible entry.

The odds of being selected in the Contest depend upon the total number of eligible entries received during the Contest Period.

All decisions of the judges are final. 

ELIGIBILITY

The Contest is only open to Canadian residents of the Provinces of British Columbia, Alberta, Saskatchewan and Manitoba that have reached the age of majority in their province as of Monday, February 8, 2010 that are current Shaw customers. Excluding employees, representatives and agents of Corus Entertainment and Shaw, its parent, related and affiliated companies, advertising and promotional agencies and the members of households of such employees, representatives and agents are not eligible to enter the Contest.

By entering the Contest entrants agree to comply with these Official Contest Rules and Regulations and all decisions of the judges, which shall be final and binding on all entrants in matters relating to this Contest. 

CONSENT TO USE OF PERSONAL INFORMATION

By entering this Contest entrants consent to the use of their name, city of residence, voice, image on videotape and/or photograph in any publicity/promotion and programming purposes, commercial or otherwise, in all media used by Movie Central or its promoters and their advertising and promotional agencies, in perpetuity, without any payment or compensation.  The declared Grand Prize winner and Secondary Prize winners shall sign a waiver and release to this effect.

By entering this Contest electronically and voluntarily providing personal information, entrants  consent and agree to Movie Central's collection, use, and disclosure of the entrant's personal information for the purpose of administering the Contest, including contacting an entrant in relation to the Contest and disclosure of a winners list.  Movie Central will not use an entrant's personal information for any other reason, nor will Movie Central otherwise disclose an entrants personal information to any third party.  See Movie Central's on-line Privacy Policy for information on how personal information received is handled in respect of the Contest at http://www.moviecentral.ca/content/privacypolicy.aspx.

GENERAL CONDITIONS

All Contest entries become the property of Movie Central and no correspondence will be entered into except with selected entrants and those who request a complete set of Contest Rules and Regulations by sending a self-addressed postage-stamped envelope to: "Win With Movie Central" Contest, 64 Jefferson Ave. Unit 18, Toronto, ON, M6K 3H4.

By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules and Regulations, including eligibility requirements.  Entrants release and hold harmless Movie Central, its parent, related and affiliated companies, subsidiaries, members, dealers, advertising, franchisees, promotional agencies and prize providers and each of their respective directors, successors, sponsors, partners, licensees, officers, subsidiaries, agents, employees, advisors, assignees, and all others associated with the development and execution of the Contest, from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, or property damage which the entrant or his/her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the entrant?s participation in the Contest and/or in connection with  the acceptance and/or exercise by the entrant of the prizes awarded.

Movie Central is not liable for missed flights, lost or damage of property associated with the Grand Prize Package.

No responsibility will be taken by Movie Central for lost, delayed, mutilated or misdirected entries, or computer system failure.  No responsibility will be taken by Movie Central for any failure of the Contest web site during the Contest or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by  Movie Central on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof including any injury or damage to an entrant's or any other person's computer or property related to or resulting from participating in, or downloading any material relating to, the Contest. In the case of on-line entries, in the event of a dispute regarding any entry, the entry is deemed made by the authorized account holder of the e-mail address submitted at the time of entry (i.e. the person who is assigned to an e-mail address by an internet access provider, online service provider or other organization responsible for assigning e-mail address for the domains associated with the submitted e-mail address).

Movie Central reserves the right, in its sole and absolute discretion; to cancel or suspend this Contest without notice should a virus, bug or any other cause beyond the reasonable control of Movie Central corrupt the security or proper administration of the Contest.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Movie Central reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.  Entries are subject to verification by the judges and will be declared invalid if they are forged, falsified, altered or tampered with in any way.

This Contest is subject to all applicable Federal, Provincial and Municipal laws.

Movie Central reserves the right to reserves the right to suspend, modify or terminate this Contest and/or these Official Contest Rules and Regulations at any time prior to the Contest Closing Date, for any reason, without any prior notice terminate or withdraw this Contest and/or these Contest Rules and Regulations at any time prior to the Contest Closing Date, for any reason, without any prior notice.
